Issues related to statelessness and the legal status of stateless persons are regulated by the Constitution of Georgia, the law of Georgia “On the Legal Status of Aliens and Stateless Persons”; by the Organic Law of Georgia “On Georgian Citizenship”, by the Ordinance of the Government of Georgia №523 (1 September 2014) „On Approval of the Procedures for Determining the Status of a Stateless Person in Georgia” and other related acts. According to Georgian legislation, a stateless person is a person who is not considered a citizen by any state under its legislation.
The Constitution of Georgia states that Citizenship of Georgia is acquired by birth or naturalization and the deprivation of citizenship is inadmissible. Citizens of other states and stateless persons living in Georgia shall have rights and obligations equal to those of citizens of Georgia except in cases provided for by the Constitution and law. The State shall be entitled to impose restrictions on the political activities of citizens of other states and stateless persons. The constitution of Georgia also stipulates that Georgia shall grant asylum to citizens of other states and stateless persons. The expulsion or extradition of persons from Georgia in violation of universally recognized principles and norms of international law shall be inadmissible.
The state’s obligation to establish legal guarantees for stateless persons in Georgia is reinforced by national legislation. In Particular, protect universally recognized rights of aliens and stateless persons irrespective of race, color, language, gender, religion, political, and other views, nationality, ethnic and social belonging, origin, property status, and rank. Additionally, strengthen the rights of free movement and free choice of residence, as well as the free choice of activity and profession as guaranteed by the Constitution of Georgia, etc.
